Nevada deputy pulls over car, arrests own wife

ELKO, Nev. (AP) - This might make for a tense time at home.

An off-duty sheriff's deputy in Nevada was pulled over and charged with driving under the influence - the arresting officer, her husband.

Charlotte Moore, a 36-year-old jail deputy and 11-year veteran, was driving her 2004 Pontiac Grand Am when she was pulled over by Elko County Sheriff's Deputy Mike Moore.

A published report says the woman allegedly drove off before she could be given a breathalyzer test. Her husband is said to have pulled her over again and called the Elko Police Department for backup.

Charlotte Moore is now on paid administrative leave.

She reportedly had been drinking during a downtown business group's wine walk.

Heres more on this one ::

Off-duty deputy arrested on DUI
By ALI HELGOTH — Staff Writer
Monday, August 13, 2007 1:42 PM PDT

ELKO — An Elko County Sheriff’s deputy was arrested — after being pulled over by her husband — Saturday on charges of driving under the influence of alcohol.

Charlotte Moore, 36 of Spring Creek was arrested at Sixth and Douglas streets at 11:41 p.m. She was released at 1:47 a.m. Sunday by order of the undersheriff.

Moore, a jail deputy, is an 11-year veteran of the sheriff’s office, Undersheriff Rocky Gonzalez said. She was placed on paid administrative leave Saturday night.

Moore was off duty driving her 2004 Pontiac Grand Am when she was initially pulled over by her husband, Elko County Sheriff’s Deputy Mike Moore.

Two separate accounts of the incident by Mike Moore indicate she was initially pulled over for either speeding or making an illegal turn, according to a police report.

She allegedly left before being administered a portable breathalyzer test.

Mike Moore pulled her over again and called the Elko Police Department for backup. He left shortly after officer Shane Daz arrived. Elko Police Department Sgt. Mark Butterfield was also on scene.

Mike Moore was following procedure when he asked for backup, Gonzalez said.

Neither Mike nor Charlotte Moore were available this morning for comment.

Charlotte Moore allegedly blew a .114 in a portable breathalyzer test, according to a police report.

She was reportedly drinking approximately two hours earlier at the Downtown Business Association’s wine walk.

The sheriff’s office supports the police department’s actions, Gonzalez said.

Although this traffic stop was different than most, officers treated the stop as they would any other time a deputy calls for backup, Police Chief Mike Smith said.

Are you suggesting it's wrong for an officer to arrest his own family member for breaking the law?

There has to be a lot more to this. There must be an on going domestic. Mr Deputy had his chance to sink Mrs Deputy and took the shot.

This officer should get a medal for treating her as any other intoxicated individual. To do anything else would be going down a slippery slope.

We're not talking about a speeding ticket for going 5km/h over the speed limit. We're talking about a criminal charge. Answer this question honestly; If his wife would have been Ms. Jane Public, would you not charge her?

Personally, I say shame on his wife for putting him in such an awkward position.
