Reasonable grounds definition

Postby stevola » Wed Dec 07, 2005 5:51 pm

Hi there,

I understand that the following is an official definition for "reasonable grounds" taken from cas law:
"a set of facts or circumstances which would cause a person of ordinary and prudent judgement to believe beyond a mere suspicion"

I need to get the French equivalent of that definition. Please tell me where it was taken from (a Google search didn't help).

I believe that is defined in the Canadian Criminal Code - no doubt there's a french version of that?

You're welcome.

...Sorry, but reasonable and probable grounds is not defined in the Criminal Code. It can only be found in case law.

You're partly correct. Provincial law in Ontario uses it as well.

The meaning of reasonable ground is found in R v Storrey, Supreme Court of Canada, 1990.
Look it up in the table of cases in the front of the code. You will find it annotated after Section 495.
