Re: Gun Laws Part Deux :)

The Code sets out that only reasonable grounds to believe is what's required to proceed with the charge, if the Crown has those grounds then the matter proceeds to trial, if not, it ends there. But that is not the example used by opp2. The police are not the sole party responsible for the administr...

Re: Gun Laws Part Deux :)

That's what I heard too, probably a good thing he didnt use a personal gun to shoot the intruder because the cops would likely have charged him too. No he would have been charged because it is in the publics best interest to lay the charge. Not because he used his own firearm. A investigation shoul...

Re: Saanich Police Shooting Ruling

The BC Police act actually spells out that warning shots are an option which I find very surprising. They are fucking retarded. Warning shots are sometimes used by some countries here in the sandbox (because soldiers generally don't have many UofF options, especially when you want stand off from so...

Re: Gun Laws Part Deux :)

As my esteemed colleague has pointed out , DGBH is not a "law enforcement term", it's written into the criminal code (which is why LE uses it). I think my point has been well illustrated that legally speaking this is a test case and rest assured it will be cited in any similar future situ...

Re: Gun Laws Part Deux :)

That's correct, I was referring to the BC police act which has nothing to do with RCMP officers. There are many provisions in the BC Police Act that apply to the RCMP. no doubt, but I don't think firing warning shots is one of them. The RCMP act would regulate RCMP officers for the most part. no?

Re: Gun Laws Part Deux :)

He would have been better off shooting them. As an example, municipal BC police officers have the option of firing warning shots as set out in the BC police act. Obviously this would not have been appropriate in a heavily populated area, but the guy lived in a remote rural area. Fixed that for you....

Re: Border Security Canada: Saturdays on Global

Is it not possible that the on-site producer asked him to do it again using the Miranda rights, purely for the show and it is not how the officer would do things normally? Ya, I don't think they'll ask the arrested to person to play along with this nor is it appropriate for the production team to d...

Re: Border Security Canada: Saturdays on Global

I have no doubt that he did, but reading something that is not applicable in canada and from another country is incorrect and just plain silly. Proper charter rights have to be read especially on TV. If he had time to read something from American tv, then he had time to properly arrest the female a...

Re: Border Security Canada: Saturdays on Global

I just watched a couple of episodes, pretty good show. During the first episode, a CBSA officer arrested a young American women (with blue hair) for possession of marijuana. As the CBSA officer advised the women she was under arrest and put handcuffs on, the officer told her, "You have the righ...
